Will AT&T add a data plan to my account for my Palm Pixi Plus?

I recently bought a Palm Pixi Plus from AT&T on Amazon.com through a 3rd Party shipper. I currently have my data blocked and refuse to pay/add data to my plan. I have read that in September of 2009 they made the smartphone policy. So, I was wondering if they will automatically add data to my account even though I have it blocked or what would happen. Also, if they do can I call or visit a store and have it removed.
